Rules for using the Personal Account service by the Client (full access)

These rules determine the procedure for using the Personal Account service (full access) on the Forwarder's official website www.loginof.ru (hereinafter referred to as “Personal cabinet ").


CONCEPTS AND DEFINITIONS USED IN THESE REGULATIONS

Agreement - Road transport agreement, public offer (hereinafter - the Agreement).

Forwarder - Loginof Limited Liability Company.

Client - an individual, a legal entity acting on the side of the Clients under the Agreement.

“My Account” (full access) - space on the Forwarder’s website www.loginof.ru , an Internet service that regulates electronic document flow between the Parties within the framework of the concluded Agreement, which allows access to services under the agreement and to manage these services. Full access to the Personal Account implies the possibility of the Customer performing the administrative functions provided for in the Agreement.

“My Account” (limited access) - space on the Forwarder’s website www.loginof.ru , an Internet service that regulates electronic document flow between the Parties within the framework of the concluded Agreement, which allows access to a limited number of operations, information on which is available on the Forwarder's website (calculation of cost at public tariffs, execution of an application for transportation and delivery to an address, verification of delivery status by invoice number, automatic billing, processing of applications for accounting documents), without the ability to carry out the administrative functions provided for in the Agreement.

Login - a unique sequence of characters used to authorize the Client.

Password - a sequence of characters known only to the Client associated with the login. The password is set by the user independently.

Authorization - an attestation of the eligibility of the Client and his appeal to the “Personal Account” service for transactions.


1. FUNCTIONALITY OF THE SERVICE “PERSONAL CABINET” (full access)

1.1. At the Customer’s request, the Forwarder provides access to the Personal Account service.

1.2. Using the “My Account” service allows the Client to independently obtain interactive access to the following operations:

- registration of an application for the organization of trucking;

- suspension / resumption of delivery of goods;

- receiving information about the location of the goods;

- sending an application for additional services / rejection of additional services;

- other operations.

1.3. All actions and changes made by the Client in the Personal Account are legally significant actions aimed at the realization of the rights / obligations of the Client within the framework of the concluded Agreement. The client is responsible for all actions committed in the "My Account".

1.4. When changing the list of operations in the Personal Account service, the Forwarder informs the Client by posting a message on the website www.loginof.ru and / or sending an electronic message to personal account and / or to the email address specified in the request / application.


2. ACCESS ORDER

2.1. If the Client needs to get access to the “Personal Account” service (full access), the Client, in accordance with the information posted on the Forwarder’s website, takes the necessary steps to gain access to the “Personal Account” service (limited access). Upon the fact of gaining access to the Personal Account service (limited access), the Client provides the Forwarder with a request / application for full access directly in his Personal Account (with limited access), attaching scanned copies of documents:

- for legal entities / individual entrepreneurs - a statement, a power of attorney for an authorized representative of a legal entity, if the statement is not signed by the head of the organization.

2.2. The rules of clause 2.1. apply subject to the presence of the Contract (signed by the two parties) at the Client (legal entity). In the absence of an Agreement signed on both sides, the Client (legal entity) must obtain an application at the location of the Forwarder (legal address or address of the location of a separate structural unit of the Forwarder) to gain access to the Personal Account service (full access).

2.3. After the Forwarder receives the request / application, the Forwarder within three working days configures the “Personal Account” service (full access). Based on the results of the set up, the Forwarder sends a message on the provision of full access to the “Personal Account” to the email address specified by the Client in the request / application. The Client’s email for limited access must match the email for full access.

2.4. To activate the Personal Account service (full access), the Client goes to the Internet resource www.loginof.ru , selects the Personal Account tab in the menu »And enters the username and password known only to the Client in the registration field.


3. SERVICE TERMS AND CONDITIONS

3.1. Access to the Personal Account service, as well as the transmission of information to the Client, depends on the functioning of the communication networks of the Internet providers of the Client, which lie outside the scope of the Forwarder's activities.

3.2. The Forwarder is not responsible for the compatibility of the Personal Account service with the data, programs, configurations, and other hardware and software resources of the Client.

3.3. The Forwarder has the right to carry out preventive work in the hardware and software complex with a temporary suspension of its work, notifying the Client in advance by posting an announcement on the site www.loginof.ru indicating the timing of its planned completion.

3.4. The parties undertake to ensure the confidentiality of personal data and the security of personal data during processing in accordance with the current legislation of the Russian Federation.


4. RIGHTS AND OBLIGATIONS OF THE CLIENT

4.1. The Personal Account service is provided only after the Customer has completed the registration procedure.

4.2. When using the Personal Account service, the Client agrees to provide reliable and complete information, and, if necessary, maintain this information up to date.

4.3. If the Client provides incorrect information or the Forwarder has reason to believe that the information provided by the Client is incorrect, incomplete or inaccurate, the Forwarder has the right to suspend or unregister the Client and refuse to provide the Personal Account service. In this case, the date of termination of the provision of the Personal Account service shall be considered the date indicated by the Forwarder in the notification sent to the Client about the termination of the provision of the Personal Account service to the Client's email address.

4.4. The Client confirms that all information received / sent by the Client and / or the Forwarder in the “Personal Account” (including by authorized representatives), containing any information regarding the occurrence / change / termination of the rights and obligations of the parties under the Agreement posted on the website http://www.loginof.ru , is valid, has legal force.

4.5. The Client is obliged to ensure the storage of password information and not to transfer the password information to third parties, including persons unauthorized to perform administrative operations with the cargo, as well as to immediately notify the Forwarder that the password has become known to third parties. The Forwarder has the right to suspend the use of the password by the Client on the basis of the Client’s request, transmitted in a way that allows the Forwarder to establish that such a request comes from the Client, and also if the Forwarder has reason to believe that unauthorized use of the Personal Account service on behalf of the Client is possible.

5. RIGHTS AND OBLIGATIONS OF THE FORWARDER

5.1. The freight forwarder agrees to provide access to the “Personal Account” service after the transfer of the signed Application / scan copy of the passport / power of attorney and the registration procedure, except as provided in clause 5.3.

5.2. The Forwarder is obliged to ensure the continuous operation of the “Personal Account” service 24 hours a day, 7 days a week, with the exception of scheduled maintenance, the period of which is indicated on the Forwarder's website. Suspensions in the work of the Personal Account service are possible due to interruptions for the prevention, repair and restoration after failures and errors, with the exception of the suspension of the service in accordance with clause 5.3.

5.3. The Forwarder reserves the right to temporarily suspend, change the order of provision or terminate the provision of the “Personal Account” service by notifying the Client in a timely manner by e-mail or through the Forwarder’s website.

5.4. The Forwarder has the right to change the composition of operations included in the “Personal Account”, having previously notified the Client about this.

5.5. The Forwarder agrees to take measures to prevent unauthorized access of third parties to confidential information related to the use of the Personal Account service by the Client.

6. RESPONSIBILITY OF PARTIES

6.1. The Client bears risks and is fully responsible for the accuracy and completeness of the information provided in the Personal Account, for actions performed in the Personal Account aimed at controlling the fate of the cargo, making changes to the transport expedition process, etc., as well as for partial provision, absence or providing false information to the Forwarder.

6.2. The Forwarder is not responsible for any malfunctions in hardware or software (including computer viruses), communications, as well as malfunctions caused by the Internet providers of the Client (s) or the Forwarder.

6.3. Under no circumstances shall the Forwarder be liable for unforeseen damage caused unintentionally, including (but not limiting) damage resulting from loss of profit, disclosure of confidential information, etc.

6.4. The Forwarder is not responsible for unauthorized interception, for the use of the Customer’s data, for the use of the Customer’s login and password by third parties, for third-party access to the information contained in the “Personal Account” of the Customer, including those of a confidential nature or other commercial interest, that have received access to this information with the knowledge or negligence of the Client.

7. SAFETY

7.1. The Client agrees to the automated processing of his personal data by the Forwarder, as well as without the use of automation tools, namely the performance of the actions provided for in paragraph 3 of Art. 3 of the Federal Law of July 27, 2006 No. 152-ФЗ “On Personal Data”, with information provided by the Forwarder. Consent is valid from the date of signing of this Agreement until the day of withdrawal in writing.

7.2. By signing this Agreement, the Client agrees to receive newsletters from the Forwarder to his email address and the information is sent to the Client’s Personal Account.

7.3. The client is responsible for the safety of individual authorization data.

7.4. The use by third parties of the individual authorization data provided to the Client gives rise to rights and obligations directly from the Client.

7.5. The Client agrees that he undertakes to immediately notify the Forwarder in writing or by e-mail of any case of loss (suspected loss) of authorization data. In the event of loss (suspicion of loss) of authorization data, the Client undertakes to change the authorization data to new ones.

7.6. Within the limits of the functioning of the Personal Account service, the Forwarder shall observe the confidentiality of information about the Client, with the exception of cases provided for by the current legislation of the Russian Federation.

7.7. All actions of the Client in the "Personal Account" are recorded. The Forwarder reserves the right to use this information in case the Client violates the terms of this Agreement to protect his interests.

8. OTHER CONDITIONS

8.1. The parties have established the possibility for the Forwarder to use analogues of his own handwritten signature (facsimile) when signing documents requiring an appropriate signature and generated through the Personal Account service.

8.2. The terms of these rules are unlimited. Clients are notified of changes or termination of these Rules by posting on the Forwarder's website www.loginof.ru .

8.3. The client has the right to refuse the service by sending a written application to the Forwarder.
